Terms of Service

1. Agreement to Terms

By accessing or using FeedSense ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

These Terms constitute a legally binding agreement between you and Mahir Can Yüksel ("we," "us," "our"), the operator of FeedSense, based in Turkey.

2. Service Description

FeedSense is a feedback management platform that allows you to:

• Collect user feedback through embedded widgets
• Analyze feedback using AI-powered insights
• Organize and prioritize feature requests
• Collaborate with team members

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

3. Account Registration

To use FeedSense, you must:

• Be at least 18 years old
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access

You are responsible for all activities under your account.

4. Subscription Plans and Billing

4.1 Plans

We offer multiple subscription plans:

• Starter: $29/month or $290/year
• Growth: $69/month or $690/year
• Professional: $199/month or $1,990/year
• Enterprise: Custom pricing

4.2 Free Trial

All paid plans include a 14-day free trial. You will not be charged until the trial ends. You may cancel during the trial without charge.

4.3 Payment

Payments are processed securely by Paddle.com. By subscribing, you authorize Paddle to charge your payment method:

• At the end of your free trial
• On each renewal date (monthly or annually)
• For any additional services or overages

4.4 Automatic Renewal

Subscriptions automatically renew unless you cancel before the renewal date. You will receive an email reminder 7 days before renewal.

4.5 Price Changes

We may change subscription prices with 30 days' notice. If you are a Founding Member (first 100 customers), your price is locked for life and will never increase.

5. Refund Policy

We offer a 30-day money-back guarantee:

• Cancel within 30 days of your first payment for a full refund
• No refunds for renewals (you must cancel before renewal)
• Refunds processed within 5-10 business days via original payment method

To request a refund, email info@feedsense.co with your account details.

6. Cancellation

You may cancel your subscription at any time:

• From your account settings
• By emailing info@feedsense.co

Upon cancellation:

• You will retain access until the end of your billing period
• No further charges will occur
• Your data will be retained for 30 days, then permanently deleted

7. Acceptable Use

You agree NOT to:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Transmit harmful code (viruses, malware)
• Scrape or harvest data without permission
• Reverse engineer the Service
• Use the Service for spam or phishing
• Resell or redistribute the Service without authorization
• Exceed usage limits for your plan

Violation may result in immediate account termination without refund.

8. Intellectual Property

8.1 Our Property

The Service, including all code, design, logos, and content, is owned by us and protected by copyright, trademark, and other laws. You may not copy, modify, or distribute our intellectual property without permission.

8.2 Your Content

You retain ownership of feedback data submitted through your widget. By using FeedSense, you grant us a limited license to:

• Store and process your data to provide the Service
• Use aggregated, anonymized data for analytics and improvement

9. Data and Privacy

Your use of FeedSense is subject to our Privacy Policy, which explains how we collect, use, and protect your data in compliance with Turkish KVKK law.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND:

• We do not guarantee 100% uptime or error-free operation
• We are not responsible for data loss (though we perform regular backups)
• AI analysis results are not guaranteed to be accurate
• Third-party integrations may change or break without notice

11. Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid in the past 12 months
• This includes damages from service interruptions, data loss, or security breaches

12. Indemnification

You agree to indemnify and hold us harmless from claims arising from:

• Your violation of these Terms
• Your use of the Service
• Content you submit through your feedback widget

13. Termination

We may terminate or suspend your account:

• For violation of these Terms
• For non-payment
• If we cease operations
• At our discretion with 30 days' notice

Upon termination, you will have 30 days to export your data.

14. Changes to Terms

We may update these Terms periodically. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance.

15. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Turkey.

Any disputes shall be resolved in Turkish courts. Before filing a lawsuit, you agree to attempt good-faith negotiations by contacting us at info@feedsense.co.
